This Disclaimer applies to the use of TrackNCloak ("Service", "Platform") available at trackncloak.com, operated by N&P Soft, doing business as TrackNCloak ("Company", "we", "us", "our"). By using the Service, you acknowledge and agree to the following.

1. Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free;
  • The results obtained from the Service will be accurate or reliable;
  • Any errors in the Service will be corrected;
  • The Service will meet your specific requirements or expectations.

2. No Guarantee of Advertising Platform Compliance

TrackNCloak does not guarantee that the use of its features will comply with the terms of service, policies, or guidelines of any third-party advertising platform.

This includes, but is not limited to:

  • Google Ads policies (including the Google Ads Terms of Service, Misrepresentation policy, and Cloaking policy);
  • Meta (Facebook/Instagram) Advertising Policies and Community Standards;
  • TikTok Ads policies;
  • Microsoft Advertising policies;
  • Any other advertising network or platform policies.

Advertising platforms regularly update their policies, review processes, and detection mechanisms. Features that function correctly today may be detected or prohibited by platforms in the future. We make no representations about the effectiveness or undetectability of any feature.

3. Traffic Filtering Disclaimer

TrackNCloak provides traffic filtering (commonly referred to as "cloaking") as a traffic quality management and bot protection tool. This functionality is designed to help users:

  • Filter non-human traffic (bots, crawlers, automated scripts);
  • Detect VPN, proxy, Tor, and datacenter traffic;
  • Segment traffic by geography, device, and other attributes;
  • Protect landing pages from scraping and unauthorized access.

Important acknowledgments:

  • Using traffic filtering to serve different content to ad platform review systems than to end users may violate the terms of service of those advertising platforms.
  • Such violations may result in advertising account suspension, permanent bans, loss of ad spend, legal action by the platform, or other penalties.
  • TrackNCloak is a tool provider. We provide the technology; you decide how to use it. We do not review, approve, or take responsibility for the specific content or configurations you create.
  • You assume all risks associated with your use of traffic filtering features.

4. User Responsibility

You are solely responsible for:

  • Ensuring your use of the Service complies with all applicable laws, regulations, and third-party terms of service;
  • Understanding the policies of the advertising platforms you use and the risks of violating those policies;
  • The content of your landing pages, offers, advertisements, and any other materials distributed through the Service;
  • Obtaining necessary consents from your website visitors for data collection and cookie usage;
  • Maintaining appropriate privacy policies and disclosures on your websites;
  • Any consequences resulting from your use of the Service, including account suspensions, financial losses, or legal liability.

5. Tool Provider Status

TrackNCloak operates as a neutral technology provider. We provide software tools for traffic management, analytics, and optimization. Our role is analogous to that of a web hosting provider, CDN, or analytics platform:

  • We do not direct, control, or approve how users employ our tools;
  • We do not review the content of individual campaigns, cloak rules, or landing pages;
  • We do not provide legal advice regarding advertising compliance;
  • We are not a party to any agreement between you and any advertising platform.

However, we reserve the right to terminate accounts engaged in clearly illegal activity as described in our Acceptable Use Policy.

6. No Professional Advice

Nothing on the Service or in our documentation, tutorials, blog posts, or support communications constitutes legal, financial, tax, or professional advice. Information provided is for general informational purposes only. For specific legal or compliance questions, consult a qualified professional.

7. Third-Party Services and Integrations

The Service integrates with third-party services including, but not limited to, Facebook Conversions API, TikTok Events API, Google Ads, and Razorpay. We are not responsible for:

  • The availability, accuracy, or reliability of third-party services;
  • Changes to third-party APIs, policies, or pricing;
  • Data processed by third-party services once it leaves our platform;
  • Any losses resulting from third-party service outages or changes.

8. IP Intelligence and Bot Detection

Our VPN, proxy, Tor, and datacenter detection features rely on third-party IP intelligence databases. While we strive for accuracy:

  • No IP detection system is 100% accurate;
  • False positives (legitimate users flagged as bots) and false negatives (bots not detected) may occur;
  • We do not guarantee the accuracy or completeness of IP intelligence data;
  • Detection rates may vary by region and over time as IP databases are updated.

9. Uptime and Availability

While we strive to maintain high availability, we do not guarantee any specific uptime percentage. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

10. Limitation of Liability

For the avoidance of doubt, the limitation of liability provisions in our Terms of Service apply in full to all matters addressed in this Disclaimer. In particular, we shall not be liable for any damages arising from advertising account suspensions, lost revenue, or penalties imposed by third-party platforms.

11. Indemnification

As set forth in our Terms of Service, you agree to indemnify and hold harmless TrackNCloak from any claims arising from your use of the Service, including claims related to advertising platform policy violations and any content you distribute through the Service.

12. Changes to This Disclaimer

We may update this Disclaimer from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Service constitutes acceptance of the updated Disclaimer.
